We provide expert advocacy where alimony is an issue, ensuring our clients receive equitable outcome, not paying more than they should and not receiving less than they should.
There are four types of alimony in Florida, specifically:
- Temporary Alimony: Provided during the divorce process to support a spouse who needs funds during the divorce.
- Bridge-the-Gap Alimony: Paid after the divorce to help a spouse transition to financial independence in life after divorce.
- Rehabilitative Alimony: Financially helps a spouse to acquire skills for self-support.
- Durational Alimony: Awarded for a specific period, based, in part, on the duration of the marriage to assist in supporting a spouse for a longer time period.
How is Alimony Determined in Florida: Since Florida enacted alimony reform in 2022, the Courts have had a little more guidance in determining the alimony that can be awarded. It is determined based on a number of factors including:
- Income of the paying spouse.
- Income or “imputed” income of the recipient spouse.
- The length of the marriage.
- The Financial needs and lifestyle of the recipient spouse/or a formula based on the above factors…whichever is less.
- Recipient spouse’s earning potential.
- Distribution of assets.
Modifying or Terminating Alimony: Alimony may be modified or terminated under certain conditions, such as remarriage of the recipient spouse, which, save for limited exceptions, will terminate alimony or cohabitation of the recipient spouse, or significant changes in financial circumstances or either party, including changes in employment and inheritances.
